Right to earnings-related allowance during a strike

News

27.1.2023

During a strike, you must apply for possible strike pay from your trade union. In some cases, the unemployment fund may also pay unemployment benefits during a strike.

If your work is prevented directly or indirectly due to industrial action (such as a strike or lockout) that seeks to affect the terms of your employment relationship, you are not entitled to earnings-related allowance paid by the unemployment fund for the days when the strike is ongoing.

Instead, in these situations, you can apply for strike pay from your trade union or from the union that declared the strike.

Have you been laid off during a strike?

You are entitled to earnings-related allowance for the days you are laid off if the lay-off notice was given to you before the strike notice was issued and the strike falls on the previously announced lay-off date.

In this case, remember to register as a jobseeker at the TE Office so that you can apply for the daily allowance. Tell the TE Office that you have been prevented from working due to an industrial action (strike or lockout) by another group of employees or the employer.

If you are laid off on a shortened workweek, you cannot receive earnings-related allowance for strike days that fall on the days you work.

Are you working part-time during a strike?

If you work part-time and receive an adjusted daily allowance from us, you cannot receive earnings-related allowance for the days when the strike is ongoing.

Was your work interrupted due to industrial action in another industry?

If your work is interrupted due to industrial action in another industry, you may be entitled to earnings-related unemployment allowance.

When your work is prevented due to a strike in another industry that is not aimed at affecting your terms of employment, your employer has an obligation to pay seven days of wages. If the strike that prevents your work lasts longer than seven days, you are entitled to earnings-related unemployment allowance without the five-day waiting period.

Also in this case, remember to register as a jobseeker at the TE Office so that you can apply for the daily allowance. Tell the TE Office that you have been prevented from working due to an industrial action (strike or lockout) by another group of employees or the employer.
