3 surprising ways family leave can affect your earnings-related daily allowance

Family leave can affect your earnings-related daily allowance even after you have returned to work. The effect is not always what you might expect: a new, higher salary may not immediately increase your daily allowance, a lower salary during partial care leave may not reduce it – and in some situations, child home care allowance received by your spouse may reduce your daily allowance. We have put together three situations that are good to be aware of.

1. A higher salary after family leave may not increase your earnings-related daily allowance

You return to work after family leave and receive a pay rise at the same time. However, six months later, your employment ends. Will your earnings-related daily allowance now be calculated based on your new, higher salary?

A pay rise may not immediately increase the amount of your earnings-related daily allowance. If you have not completed a new 12-month employment condition before becoming unemployed, the salary used as the basis for your daily allowance may be determined based on your previous salary.

The exact amount of the earnings-related daily allowance depends on the relevant dates, how the employment condition has been accumulated, and when the person’s previous daily allowance period or employment condition was established.

2. A lower salary during partial care leave does not reduce the amount of your earnings-related daily allowance

You are on partial care leave, which means that your working hours and salary are lower than usual. You return to full-time work, but your employment ends six months later. Will the lower salary you received during care leave reduce your earnings-related daily allowance?

In this situation, a special protective provision concerning partial care leave applies: if the employment condition has been accumulated during a period when your working hours and salary were lower than usual because you were caring for a child, the salary used as the basis for your daily allowance may be determined based on your earnings before the partial care leave. The purpose of this provision is to prevent the lower part-time salary received during care leave from reducing your daily allowance.

3. Child home care allowance received by your spouse may also reduce your earnings-related daily allowance
